{"id":551,"date":"2015-03-06T02:48:28","date_gmt":"2015-03-06T02:48:28","guid":{"rendered":"https:\/\/blogs.up.edu.pe\/csanborn\/?p=551"},"modified":"2022-10-13T06:03:21","modified_gmt":"2022-10-13T06:03:21","slug":"prior-consultation-in-peru-an-update","status":"publish","type":"post","link":"https:\/\/blogs.up.edu.pe\/csanborn\/prior-consultation-in-peru-an-update\/","title":{"rendered":"Prior Consultation in Peru: An Update"},"content":{"rendered":"<p><a class=\"lightbox\" href=\"https:\/\/blogs.up.edu.pe\/csanborn\/wp-content\/uploads\/2015\/03\/maijuna.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-552\" alt=\"maijuna\" src=\"https:\/\/blogs.up.edu.pe\/csanborn\/wp-content\/uploads\/2015\/03\/maijuna-300x168.jpg\" width=\"300\" height=\"168\" srcset=\"https:\/\/blogs.up.edu.pe\/csanborn\/wp-content\/uploads\/2015\/03\/maijuna-300x168.jpg 300w, https:\/\/blogs.up.edu.pe\/csanborn\/wp-content\/uploads\/2015\/03\/maijuna.jpg 1024w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>I recently published <a href=\"https:\/\/www.csrm.uq.edu.au\/publications\/getting-it-right-challenges-to-prior-consultation-in-peru\">this paper in English<\/a> on the implementation of the right to prior consultation in Peru for native and indigenous peoples. \u00a0 \u00a0Upon taking office in 2011, Peruvian president Ollanta Humala expressed his commitment to the implementation of ILO Convenant 169, guaranteeing the right of indigenous peoples to be consulted by the State regarding any proposed policy decision that could affect their communities and customs; including the decision to put oil and mineral resources up for concession, in the Amazon and high Andes.<\/p>\n<p>Three and a half years later, the Humala Administration is still dragging its feet. \u00a0Even the first and most emblematic consultatiaon process, regarding the creation of a nature reserve on the ancestral lands of the Maijuna and Kichwa peoples of Loreto, has been held up by the Executive. \u00a0Last week,\u00a0<a href=\"http:\/\/elcomercio.pe\/peru\/loreto\/maijunas-y-kichwas-reclaman-proteccion-sus-bosques-noticia-1794622\">Maijuna and Kichwa leaders<\/a>\u00a0travelled all the way to Lima last week to try and talk to President Humala, to no avail.
